It ain’t about the money. Most of the time disputes over money in families have little to do with the actual money. Perceived slights from 45 years ago can instantly raise their ugly heads and split a family apart. One of the ways in which we practice law differently is that we counsel our clients on not what is just legal, but what is right and the likely impact on their families of certain decisions. Generally, the right thing to do is also what will preserve wealth in that it preserves wealth from litigation.
For instance, we work with our clients on the process of distributing personal property. Personal property disputes can be some of the nasties family fights around that then lead to distrust and expensive will contests. We work with our clients who are personal representatives to ensure that there is transparency to establish and keep trust – and again hopefully avoid fighting and litigation.
The horror stories about individuals doing horrendous things in order to gain inheritance or take that special object are all too real.
Most of our clients share Brita’s father’s stance on estate planning “no fighting… not a damn thing to fight about”. With our guidance in estate planning, and probate we can guide families through the process with as minimal damage to the family as possible. We help our clients to not only know what is legal, but how to avoid lighting fires during the process.
We also work diligently to ensure that there is no elder abuse taking place with our clients – including financial abuse. If someone is exerting inappropriate influence over our client’s or directing decisions that are for his or her own interests as opposed to our client’s we take an active role in stopping such abuse. We will never be complicit in someone attempting to gain access to “their inheritance” early. In fact, we will be that person’s worse nightmare.
